1. Introduction and Agreement

These Terms of Service ("Terms") govern the services provided by Ausvera Digital Group ("Ausvera", "we", "our" or "us") to customers ("you" or "your").

By accepting a quotation, placing an order or purchasing our services, you agree to the Terms made available to you at the time of acceptance, together with the applicable quotation, scope of work and any individually agreed service conditions.

Where a quotation contains specific agreed terms, those terms apply to that project, subject to applicable law.

Nothing in these Terms excludes, restricts or modifies any non-excludable right or remedy under the Australian Consumer Law or other applicable legislation.

2. Services

Ausvera may provide:

  • Website design, development and redesign
  • Managed website hosting
  • Website maintenance and technical support
  • Branding, logo and graphic design
  • Social media management and content creation
  • Digital marketing and related services
  • Custom digital solutions and other agreed services

The accepted quotation defines the deliverables, inclusions, exclusions, fees and project requirements.

Services not expressly included in the agreed scope may be separately quoted.

3. Website Packages

Our standard advertised website packages are:

Starter Website — $699 including GST

  • Up to three website pages
  • Two rounds of reasonable revisions
  • 100% payment upfront

Business Website — $1,299 including GST

  • Up to six website pages
  • Three rounds of reasonable revisions
  • 100% payment upfront

Premium Website — from $2,499 including GST

  • Custom project scope and inclusions
  • Revision allowance specified in the accepted quotation
  • For new projects, 100% of the accepted quoted amount upfront before work begins; owner-approved milestone payments only as an explicit exception agreed in writing before acceptance

Additional website pages may be available at $129 per page including GST, where applicable and agreed.

Package features and deliverables are subject to the applicable accepted quotation.

New Website Redesign, Logo Design and other fixed-price one-time projects also require 100% of the accepted quoted amount upfront before work begins. Revision and scope arrangements are specified in the applicable quotation.

4. Payments and Additional Charges

All advertised prices are in Australian dollars and include GST.

All new Starter, Business, Premium, Website Redesign, Logo Design and other fixed-price one-time projects require 100% of the accepted quoted AUD, GST-inclusive amount upfront before work begins. Work does not begin until the required payment is verified and project requirements are ready.

Owner-approved milestone payments are an explicit exception only, with the payment schedule and written terms agreed before quote acceptance. Premium projects do not default to a split payment. Existing accepted quotes, subscriptions, historical payments and customer agreements retain their original terms.

Monthly services are billed in full in advance for each billing period. Recurring payments require the customer's separate authorisation.

Any additional features, pages, design changes or third-party expenses must be disclosed and approved in writing before extra charges apply. One-time extras require written approval and payment before extra work begins, without affecting remedies owed under Australian Consumer Law.

Ausvera may use third-party payment processors, including Stripe, for payments, recurring subscriptions and refunds.

Payment obligations do not remove statutory consumer rights.

5. Quote Acceptance and Contract Records

Customers may accept quotations through an authorised online acceptance process, written confirmation or another agreed method.

Before acceptance, customers should be given access to the applicable scope, price, payment schedule, revision allowance, recurring charges if any, and relevant legal terms.

Ausvera may maintain appropriate records of quotation versions, acceptance dates, customer responses and the Terms presented at acceptance.

A quotation acceptance does not itself authorise a payment unless the customer has separately agreed to the relevant payment process.

Changes to an accepted quotation require appropriate agreement and must not retrospectively remove existing customer rights.

6. Project Commencement and Customer Responsibilities

Projects ordinarily commence after receipt of the required payment, necessary content and relevant account access.

Customers are responsible for providing accurate business information, appropriate content, lawful images and required approvals.

Customers must have appropriate rights or permissions for materials supplied to Ausvera.

Customers should promptly communicate material changes to project requirements.

Ausvera will provide services with reasonable care and skill.

7. Project Delays and Customer Inactivity

Delivery estimates may depend on customer responses, content availability, technical complexity and third-party services.

If a customer does not provide required information or approvals, Ausvera may place the affected project on hold after making reasonable attempts to contact the customer.

Ausvera will communicate the information needed to resume work and any reasonably foreseeable scheduling consequences.

A project hold does not automatically result in forfeiture of payments.

Any proposed additional restart costs or substantial scope changes must be explained and approved before they are charged.

Where prolonged inactivity makes continuation impracticable, the parties may discuss revised arrangements or termination, subject to the accepted agreement and applicable law.

8. Revisions and Scope Changes

Starter packages include two rounds of reasonable revisions.

Business packages include three rounds of reasonable revisions.

Premium revision allowances are specified in the accepted quotation.

A revision round means one consolidated request for reasonable adjustments within the agreed project scope.

Revisions may include changes to existing text, images, colours, spacing and layouts.

Additional functionality, extra pages, major structural changes or a substantially different design direction may require a separate quotation.

Complete redesigns requested after agreed work has been completed may be treated as new work.

Additional charges require customer approval.

Corrections required to meet agreed obligations or applicable consumer guarantees will not automatically be charged as revisions.

9. Customer Review and Launch Approval

Ausvera will provide an appropriate opportunity to review completed project work before launch.

Customers should check the accuracy of business information, content and other materials supplied or approved by them.

Launch is subject to agreed project requirements, applicable payment milestones and appropriate customer approval.

Ausvera may record customer approval and the version of the project approved for launch.

Customer approval does not remove statutory rights relating to defective or non-conforming services.

10. Post-Launch Corrections and Support

Ausvera will assess reports of defects or work that does not conform to the agreed project requirements.

Where correction is required under the contract or applicable consumer guarantees, Ausvera will provide the appropriate remedy without treating the matter as an ordinary paid maintenance request.

New content requests, optional enhancements, additional functionality and unrelated changes after launch may require a maintenance subscription or separate quotation.

No fixed post-launch warranty period is intended to limit non-excludable statutory rights.

11. Project Cancellation and Refunds

Customers may request cancellation of a website project by contacting Ausvera.

Any refund or outstanding amount will be assessed fairly according to the accepted agreement, work completed, reasonable costs incurred, the reason for cancellation and applicable law.

Upfront payments are not automatically non-refundable.

Ausvera will not impose unlawful or unfair cancellation penalties.

Customers retain applicable statutory remedies where services do not meet consumer guarantees.

Further information appears in the Refund and Cancellation Policy.

12. Managed Website Hosting

Optional Ausvera-managed hosting starts at $29 per month including GST for eligible standard websites, where the selected arrangement has been verified before sale. This is not a guaranteed price for every website or platform. More demanding websites, including certain Lovable applications, e-commerce sites and database-backed projects, may require separately quoted hosting or platform fees.

Ausvera may develop and manage websites using WordPress, Framer, Lovable or other suitable platforms. Hosting may be Ausvera-managed, where Ausvera administers an approved arrangement and bills the customer, or client-owned, where the customer contracts with and pays the provider directly and Ausvera provides authorised management services where agreed. The selected platform, hosting provider, account ownership, billing responsibility and relevant service limitations must be documented in the accepted quote or service agreement. Ausvera does not need to purchase hosting subscriptions before a paying client requires them.

Before commitment, the applicable hosting arrangement must disclose setup costs, subscription charges, provider renewal pricing, third-party expenses, storage and bandwidth limits, verified backup and restoration arrangements, support limits and relevant dependencies. No provider prices or capabilities are assumed.

Hosting does not automatically include unlimited storage, premium licences, domain renewal, major development or unlimited support.

Ausvera does not guarantee 100% uptime or uninterrupted service.

Ausvera remains responsible for performing its agreed hosting services with reasonable care and skill.

13. Website Maintenance

Optional website maintenance is available at $79 per month including GST.

The standard plan includes up to 15 minutes of minor website edits per billing month.

Unused editing time does not carry forward.

Minor edits may include reasonable updates to existing text, images and contact details within the existing website structure.

Major redesigns, additional pages, new functionality and substantial development are excluded unless separately agreed.

Additional approved work is charged at $79 per hour including GST, unless another price is agreed in writing.

Standard support hours are Monday to Friday, 9:00 am to 5:00 pm Queensland time, excluding Queensland public holidays.

Support is provided within reasonable operational capacity and does not include guaranteed immediate responses or 24-hour assistance.

14. Combined Hosting and Maintenance

Eligible standard websites may receive hosting and maintenance together from $108 per month including GST. More demanding websites or platforms may require separately quoted hosting or platform fees; the final arrangement and price must be agreed before commitment.

Each service remains optional.

The applicable inclusions and exclusions continue to apply.

Customers will be informed whether the services are billed together or through separate subscriptions.

15. Subscription Billing and Cancellation

Recurring subscriptions renew at the disclosed billing interval until cancelled.

Customers will be informed of the recurring price, frequency and cancellation arrangements before subscribing.

Customers may cancel future renewals through the available customer billing portal or by contacting Ausvera.

No mandatory 30-day advance cancellation notice applies.

Cancellation ordinarily takes effect at the end of the current paid billing period.

Future renewals stop once cancellation becomes effective.

Customers ordinarily retain their paid services until the end of that billing period, subject to applicable law and agreed arrangements.

Cancellation of one separately billed service does not automatically cancel another.

Statutory refund and other rights remain unaffected.

16. Subscription Price Changes

Ausvera may propose changes to recurring service prices.

Customers will receive appropriate advance notice of material price increases, including the new price and proposed effective date.

Where a price increase requires customer agreement under the applicable contract or law, Ausvera will obtain that agreement before applying the increase.

Customers will have a reasonable opportunity to cancel future renewals before a notified increase takes effect.

Price changes will not be applied retrospectively to completed billing periods.

17. Failed Payments and Suspension

Where a payment fails, Ausvera or its payment provider may notify the customer and attempt authorised payment recovery.

Customers may be asked to update their payment details or settle an outstanding invoice.

Ausvera may suspend affected services for material non-payment after reasonable notice, where lawful and appropriate.

Suspension or termination will be handled consistently with the agreement and applicable consumer protections.

Customer-owned domain names will not be improperly withheld to pressure payment.

18. Hosting Termination and Planned Service Changes

Customers may request cancellation or transfer of their hosting services in accordance with the agreed billing arrangements.

Where Ausvera intends to discontinue a hosting service or materially change its hosting arrangements, it will provide reasonable advance notice where practicable and required by law.

Hosting access may end after the paid billing period, subject to applicable contractual and legal obligations. Ausvera will provide a reasonable opportunity to obtain agreed client-owned materials before termination and will not interfere with lawful customer access to their domain.

Emergency security incidents, unlawful activity or serious infrastructure failures may require urgent action.

Termination will not remove applicable statutory rights or agreed handover obligations.

19. Domain Ownership and Renewals

Customers retain their rights as registered holders of their domain names, subject to applicable domain registry rules.

Where Ausvera registers a domain on a customer's behalf, it must be registered in the customer's correct legal or business name wherever the registrar permits, with Ausvera acting as an authorised manager. The registrar, ownership and access arrangements must be documented.

Domain registration, renewal and transfer costs are separate unless expressly included in the accepted quotation.

The responsible party for domain renewals and associated payments, and applicable costs, must be identified in the customer agreement. Any first-year domain allowance of up to $30 applies only where expressly included in the accepted written quote. Future renewals require appropriate disclosure and customer approval.

Customers may request lawful domain transfers.

Ausvera will not impose unfair exit charges or intentionally obstruct legitimate transfers.

20. Website Ownership and Intellectual Property

Customers retain ownership of materials they lawfully provide.

Following full payment, customers own their agreed custom website deliverables, subject to third-party licensing restrictions, pre-existing materials and expressly disclosed platform limitations.

Ausvera retains rights in its pre-existing intellectual property, reusable components, internal tools, proprietary systems and development methods.

Third-party software, plugins, templates, stock assets, fonts and platform-specific components remain subject to applicable licensing arrangements.

Material website portability, export and independent hosting limitations will be disclosed before purchase.

No intellectual property rights are transferred beyond those expressly agreed or required by law.

21. Website Handover and Migration

Customers may request transfer of hosting or website management to another provider.

Ausvera provides free handover of existing client-owned files, available account and domain access, and agreed deliverables, subject to appropriate security, technical and licensing limitations. No separate exit or basic handover fee applies simply because the customer cancels hosting. Handover does not include proprietary platform infrastructure, third-party licences or materials Ausvera has no legal or technical right to transfer.

Where feasible, Ausvera will provide a written handover summary identifying materials and access transferred.

Additional technical work to move, rebuild, configure, deploy or troubleshoot a website on another provider is distinct from free basic handover and may require a separate quotation.

Optional migration work requires written customer approval before any charge is incurred and payment before the extra work begins under the agreed payment terms.

Ausvera will not impose unfair lock-in conditions or intentionally obstruct lawful domain transfers.

Specific export, retention and deletion arrangements will be disclosed in the applicable service agreement.

22. Third-Party Fees, Licences and Renewals

Projects may depend on third-party hosting, domains, plugins, software, stock assets, advertising platforms and other services.

Ausvera will disclose material third-party costs and dependencies before purchase.

The accepted quotation should identify which third-party charges are included and which remain the customer's responsibility.

Third-party subscriptions, renewals and licences may be subject to separate terms.

Ausvera will not incur additional customer-payable expenses without appropriate authorisation.

23. Client Portfolio and Showcase Rights

Ausvera may display completed, publicly available client websites, business names, logos and non-confidential project examples in its portfolio, website, social media and promotional materials, to the extent permitted by applicable intellectual property law and the customer's agreement.

Customers may opt out at any time by contacting hello@ausvera.com.au.

Ausvera will respect agreed confidentiality restrictions and will not disclose private customer information, unpublished project materials or confidential business information.

Upon receiving an opt-out request, Ausvera will remove the relevant materials from promotional channels under its control within a reasonable period.

Portfolio use does not transfer ownership of customer intellectual property to Ausvera.

24. Social Media and Digital Marketing Services

Social media management, branding, graphic design and digital marketing services are supplied according to the accepted quotation.

The quotation should identify relevant deliverables, posting schedules, revision allowances, advertising budgets, account access arrangements and management responsibilities.

Advertising expenditure is separate unless expressly included.

Customers remain responsible for the accuracy of business claims and content they supply or approve.

Ausvera does not guarantee specific search rankings, enquiries, sales, advertising results or social media engagement.

25. Customer Content and Acceptable Use

Customers must ensure that content supplied for use in their projects is lawful and appropriately authorised.

Customers must not knowingly provide malicious software, unlawful content or materials that infringe third-party rights.

Ausvera may decline requests that would require unlawful conduct.

Both parties must act reasonably in carrying out their respective contractual obligations.

26. Privacy, Security and Confidentiality

Ausvera handles personal information in accordance with its Privacy Policy and applicable law.

Ausvera will take reasonable steps appropriate to the services provided to protect customer information and restrict unauthorised administrative access.

Customers are responsible for protecting their own account credentials and promptly reporting suspected unauthorised access.

Confidential business information will be handled appropriately, subject to lawful disclosure requirements.

Additional confidentiality or data-processing arrangements may apply where appropriate.

27. Backups, Data Retention and Restoration

Backup frequency, retention, storage and bandwidth limits, uptime, restoration capabilities and associated costs depend on the verified provider, selected plan and agreed service arrangements. The accepted quote or service agreement must identify which party manages backups, website updates and security. Platforms do not offer identical security, portability or restoration capabilities.

Ausvera will not promise daily backups, unlimited storage, uninterrupted uptime or recovery capabilities unless those commitments are contractually supported by the verified arrangement.

Customers may request available exports of their content and data, subject to technical, security and licensing restrictions.

Information will be retained or deleted according to applicable legal requirements, the Privacy Policy and agreed service-specific arrangements.

28. Consumer Guarantees and Liability

Ausvera will provide services with reasonable care and skill.

Nothing in these Terms excludes, restricts or modifies any non-excludable guarantee, right or remedy under the Australian Consumer Law or other applicable legislation.

Any contractual limitation of liability applies only to the extent permitted by law.

Customer approval, payment or project completion does not automatically remove statutory remedies.

29. Complaints and Dispute Resolution

Customers may contact hello@ausvera.com.au regarding complaints, billing concerns, project disputes or service issues.

Ausvera will make reasonable efforts to investigate complaints and seek a fair resolution.

Customers retain access to applicable courts, tribunals, regulators and statutory dispute resolution processes.

30. Changes to Terms

Ausvera may update its published Terms to reflect legitimate operational or legal changes.

Material changes affecting existing customer agreements will be communicated where required.

Updated Terms do not automatically override previously accepted contractual rights without an appropriate lawful basis.

Ausvera may retain records of the versions of Terms accepted by customers.

31. Governing Law

These Terms are governed by applicable laws of Queensland and Australia, without excluding mandatory protections that may apply elsewhere.
